Terms of Service

1. The agreement
These terms are an agreement between you — the agency or business that creates an account — and QuantumCX, the operator of the Marque platform. By creating an account or using the platform you accept them. If you are accepting on behalf of a company, you confirm you are entitled to bind it.
2. What the service is
Marque is an operating platform for agencies: client workspaces with contact management, conversations, calendars, forms, funnels, automations, invoicing, reporting and related tools, offered under your own brand.
Features that depend on third-party providers — email delivery, text messaging, telephone calls, card payments, AI models — only operate live when the relevant provider is connected, and are otherwise simulated in sandbox mode. Sandbox mode contacts nobody and charges nobody.
3. Your account
You are responsible for the accuracy of what you enter, for keeping your sign-in credentials private, and for the people you invite. Anything done under your account is treated as done by you.
You may not use the platform to send spam, to violate telecommunications or privacy law, to host unlawful content, or to probe or disrupt the service. Carrier and messaging rules (such as sender registration and opt-out handling) are conditions of using the messaging features.
4. Your clients' data
The records you keep in Marque — your clients' contacts, conversations, bookings and billing — belong to you and your clients, not to us. We process them only to run the service, we do not sell them, and you can export a workspace's complete data at any time from its settings.
You are responsible for having the right to store the personal data you put into the platform, and for honouring your own clients' privacy obligations to their customers.
5. Fees
Paid plans are billed at the price agreed when you subscribe. Fees for third-party providers you connect (for example message or call charges) are your own responsibility. If a payment fails and remains unpaid, your account may be suspended after reasonable notice.
6. Availability and changes
The platform is provided as it stands, without a promise of uninterrupted availability. We work to keep it reliable and to fix faults promptly, and we may improve or change features over time. If a change materially removes something you depend on, we will tell you before it lands.
7. Liability
To the extent the law allows, our liability for any claim connected to the service is limited to the fees you paid us in the three months before the event giving rise to the claim, and neither party is liable for indirect losses such as lost profits. Nothing in these terms limits liability that cannot lawfully be limited.
8. Ending the agreement
You can stop using the platform and cancel at any time; export your data first. We may end the agreement for material breach of these terms if the breach is not put right within a reasonable notice period. After termination we delete your data within a reasonable time, except what we must keep by law.
9. Changes to these terms
We may update these terms as the product evolves. Material changes will be announced to account holders before they take effect; continuing to use the platform after that is acceptance of the updated terms.
